Legislation governing domestic firewood collection

The legislation and regulations that establish the rules for domestic firewood collection are:

  • Forests Act 1958
  • Forests (Domestic Firewood) Regulations 2012
  • Crown Land (Reserves) Act 1978
  • Crown Land (Reserves) (Domestic Firewood) Regulations 2010.

There are heavy penalties for not complying with these rules, including fines of up to 50 penalty units (current value of the maximum fine is $7,928.50) or one year imprisonment.

  • On-the spot fines are issued for a range of offences, including:
  • taking more than the daily limit of 2 cubic metres of firewood from a firewood collection area during a firewood collection season
  • cutting or taking wood for domestic firewood use from state forest outside a designated firewood collection area
  • bringing heavy vehicles / machinery into a firewood collection area
  • collecting firewood within 20 metres of a watercourse
  • cutting live or dead standing trees
  • cutting or taking a visibly hollow log or a log growing moss or fungi
  • driving off road.
  • Under the Forests (Domestic Firewood) Regulations 2012 it is an offence to:
    • tow or winch fallen trees along the ground
    • fill a chainsaw with oil or fuel unless it is on an impermeable surface

DELWP and Parks Victoria conduct routine, random or targeted patrols of forest areas, and authorised officers issue on-the-spot fines for firewood offences, with an option to take people to court for major offences.
